Terms of Service

1. Acceptance of Terms
These Terms of Service (the "Terms") constitute a binding agreement between you and Ethan Foster ("Curate," "we," "us," or "our") governing your access to and use of the Curate mobile application and any associated websites (together, the "Service"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
2. Eligibility
You must be at least 13 years of age to use the Service. By using the Service, you represent that you meet this requirement and that all information you provide to us is accurate and complete.
3. Accounts
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- Handles (usernames) are unique to each account, may be changed no more than once every 30 days, and certain handles are reserved. We reserve the right to reclaim a handle that has been released and remains unclaimed.
- You may delete your account at any time from Settings → Delete Account. Our Privacy Policy describes what this removes.
4. User Content and License
You retain all ownership rights in the restaurants, visits, notes, photographs, and comments you submit to the Service ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, process, and display it to you and to any other users your privacy settings and follow relationships permit, solely for the purpose of operating and providing the Service. We do not sell User Content or use it to train third-party models offered to the public.
You are solely responsible for your User Content and for ensuring you have all rights necessary to submit it, including rights in any photographs you did not take yourself.
5. Acceptable Use
In connection with the Service's social features (including follows, feed, comments, tags, and reactions), you agree not to:
- Harass, threaten, or abuse another user, or submit User Content that does so;
- Impersonate any person or misrepresent your affiliation with any person or entity;
- Submit unlawful, infringing, or sexually exploitative content;
- Tag another user in a visit they were not actually part of, or without a good-faith basis for doing so;
- Attempt to circumvent a user's privacy settings, blocks, or the follow-approval process;
- Scrape, reverse-engineer, or use automated means to access the Service beyond ordinary use; or
- Transmit spam or malicious code through the Service.
6. Reporting and Enforcement
You may report a user, comment, or visit from within the Service. Reports are reviewed under restricted administrative access. We may, in our discretion and without prior notice where warranted, remove content, restrict functionality, or suspend or terminate an account that violates these Terms.
7. Third-Party Services
The Service relies on third-party service providers, including cloud infrastructure, mapping and places data, artificial-intelligence processing for image and text recognition, push-notification delivery, and third-party sign-in providers. Your use of these integrations is subject to our Privacy Policy. We are not responsible for the independent acts or omissions of third-party providers.
8. Disclaimer of Warranties
The Service is currently provided free of charge on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that data will never be lost. You are responsible for maintaining independent backups of any irreplaceable information (for example, using the export feature in Settings).
9. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or relating to your use of, or inability to use, the Service, whether based on contract, tort, or any other legal theory, even if advised of the possibility of such damages.
10. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your User Content, your violation of these Terms, or your violation of any right of a third party.
11. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service, in whole or in part, if we determine that you have violated these Terms.
12. Changes to the Service or These Terms
We may modify, suspend, or discontinue any part of the Service at any time, and may introduce paid features in the future with reasonable advance notice. We may revise these Terms from time to time; material changes will be reflected by updating the date above. Your continued use of the Service following any change constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of Australia, without regard to its conflict-of-law principles, and you agree to submit to the exclusive jurisdiction of the courts located in Australia for the resolution of any dispute arising under these Terms.
14. General Provisions
If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision. These Terms constitute the entire agreement between you and us regarding the Service and supersede any prior agreements. You may not assign these Terms without our prior written consent; we may assign these Terms without restriction.
